1. Acceptance of Terms
By creating an account, accessing, or using YatriCourier ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform. These Terms constitute a legally binding agreement between you and YatriCourier (operated by the Platform owner).
You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding agreements.
2. Platform Description
YatriCourier is a peer-to-peer courier marketplace that connects travellers with senders. The Platform facilitates the connection between individuals who are travelling ("Travellers") and individuals who wish to send parcels ("Senders"). YatriCourier acts solely as an intermediary platform and does not itself provide courier, logistics, or transportation services.
YatriCourier does not take possession of, transport, or deliver any parcels. All arrangements for pickup, transport, and delivery are made directly between Travellers and Senders.
3. User Accounts and Registration
3.1. You must provide accurate, complete, and current information during registration.
3.2. You are responsible for maintaining the confidentiality of your account credentials.
3.3. You are responsible for all activities that occur under your account.
3.4. You must immediately notify us of any unauthorized use of your account.
3.5. One person may only maintain one account. Creating multiple accounts is prohibited and may result in permanent suspension.
3.6. We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.
4. KYC Verification
4.1. Users may be required to complete Know Your Customer (KYC) verification by submitting identity documents (Aadhaar card).
4.2. Submitting false, forged, or another person's identity documents is a criminal offense and will result in immediate account termination and reporting to law enforcement authorities.
4.3. KYC verification does not guarantee the trustworthiness of a user. Users must exercise their own judgment when transacting.
4.4. Your Aadhaar data is processed securely — raw numbers are never stored. Only masked versions and cryptographic hashes are retained.
5. Prohibited Items
Users are strictly prohibited from sending, carrying, or facilitating the transport of the following items through the Platform:
- Explosives, firearms, ammunition, or weapons of any kind
- Narcotics, illegal drugs, or controlled substances
- Hazardous, flammable, corrosive, or radioactive materials
- Counterfeit currency, forged documents, or pirated goods
- Stolen property or goods obtained through illegal means
- Human remains, organs, or body parts
- Live animals (unless specifically permitted by applicable law)
- Pornographic, obscene, or offensive material
- Items prohibited under the Indian Post Office Act, 2023
- Items prohibited under the Arms Act, 1959
- Items prohibited under the Narcotic Drugs and Psychotropic Substances Act, 1985
- Items prohibited under the Wildlife Protection Act, 1972
- Perishable goods without proper packaging and disclosure
- Liquids that may leak and damage other items
- Any item whose transport violates applicable Indian law
Violation of this section may result in immediate account termination, forfeiture of any payments, and reporting to law enforcement authorities. Users may face criminal prosecution under applicable Indian laws.
6. Sender Responsibilities
6.1. Senders must accurately describe the contents, weight, and dimensions of their parcels.
6.2. Senders must not misrepresent the contents of a parcel. Concealing prohibited items within a parcel is a criminal offense.
6.3. Senders are solely responsible for ensuring their parcels comply with all applicable laws and regulations.
6.4. Senders must properly package their items to prevent damage during transit.
6.5. Senders acknowledge that Travellers are private individuals, not professional courier services, and accept the inherent risks of peer-to-peer delivery.
6.6. Senders must not send items of extraordinary value (jewelry, large cash amounts, irreplaceable documents) without explicit disclosure and mutual agreement with the Traveller.
6.7. If a Sender knowingly sends prohibited or illegal items, they shall be solely liable for all legal consequences, fines, penalties, and damages arising therefrom, and shall indemnify YatriCourier and the Traveller against all claims.
7. Traveller Responsibilities
7.1. Travellers must exercise reasonable care in handling and transporting parcels.
7.2. Travellers must not open, tamper with, or inspect the contents of sealed parcels without the Sender's consent.
7.3. Travellers must deliver parcels to the agreed destination and recipient.
7.4. Travellers must upload proof of delivery (photo) when marking a parcel as delivered.
7.5. Travellers have the right to refuse any parcel they suspect contains prohibited items.
7.6. Travellers must not steal, misappropriate, or intentionally damage parcels entrusted to them.
7.7. Theft or misappropriation of a parcel by a Traveller constitutes criminal breach of trust under Section 405/406 of the Indian Penal Code (now Section 316 of Bharatiya Nyaya Sanhita, 2023). YatriCourier will cooperate fully with law enforcement and provide all available evidence (KYC documents, communication records, delivery proof) to assist in prosecution.
7.8. In case of loss or damage due to Traveller's negligence, the Traveller shall be liable to compensate the Sender for the declared value of the parcel or the actual loss, whichever is lower.
8. Pricing and Payments
8.1. Pricing for delivery services is agreed upon directly between Senders and Travellers.
8.2. YatriCourier does not currently process payments. All financial transactions occur directly between users.
8.3. Users are responsible for settling payments as agreed. Failure to pay agreed amounts may result in account restrictions.
8.4. Additional charges (home pickup: ₹100, home delivery: ₹100) are clearly displayed and must be agreed upon before booking.
8.5. Counter-offers and price negotiations must be conducted in good faith through the Platform.
9. Limitation of Liability
9.1. YatriCourier is a marketplace platform only. We do not guarantee the completion, safety, or quality of any delivery.
9.2. YatriCourier shall not be liable for any loss, damage, theft, or delay of parcels.
9.3. YatriCourier shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
9.4. YatriCourier's total liability, if any, shall not exceed the platform fees charged for the specific transaction in question.
9.5. YatriCourier does not guarantee the identity, reliability, or trustworthiness of any user, even if KYC-verified.
9.6. Users transact at their own risk and are encouraged to take reasonable precautions (meeting in public places, verifying identities, not sending high-value items without insurance).
10. Dispute Resolution
10.1. In case of disputes between Senders and Travellers, users should first attempt to resolve the matter through the in-app messaging system.
10.2. If direct resolution fails, users may contact YatriCourier support at support@yatricourier.com for mediation assistance.
10.3. YatriCourier's mediation is non-binding and provided as a courtesy. We are not obligated to resolve disputes between users.
10.4. For disputes involving theft, fraud, or criminal activity, users should file a complaint with local law enforcement authorities.
10.5. Any legal disputes arising from these Terms shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India.
10.6. These Terms shall be governed by and construed in accordance with the laws of India.
11. Prohibited Conduct
Users must not:
- Use the Platform for any unlawful purpose
- Impersonate another person or entity
- Create fake bookings or travel plans
- Manipulate pricing, reviews, or ratings
- Harass, threaten, or abuse other users
- Attempt to circumvent the Platform to avoid fees or accountability
- Use automated tools, bots, or scrapers on the Platform
- Interfere with the Platform's operation or security
- Share another user's personal information without consent
- Use the Platform to facilitate money laundering or terrorist financing
12. Intellectual Property
12.1. All content, design, logos, and software on the Platform are owned by YatriCourier and protected by intellectual property laws.
12.2. Users may not copy, modify, distribute, or create derivative works from Platform content without written permission.
12.3. By posting content (reviews, messages, photos), users grant YatriCourier a non-exclusive, royalty-free license to use such content for Platform operations.
13. Account Termination
13.1. Users may delete their account at any time by contacting support@yatricourier.com.
13.2. YatriCourier may suspend or terminate accounts for violation of these Terms, suspicious activity, or at our sole discretion.
13.3. Upon termination, users lose access to all Platform features and data associated with their account.
13.4. Sections relating to liability, indemnification, and dispute resolution survive account termination.
14. Indemnification
You agree to indemnify, defend, and hold harmless YatriCourier, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any parcel you send or carry through the Platform
- Any dispute between you and another user
15. Privacy
Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your information as described therein.
16. Modifications
16.1. YatriCourier reserves the right to modify these Terms at any time.
16.2. Material changes will be notified via email or Platform notification.
16.3. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
17. Force Majeure
YatriCourier shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, strikes, internet outages, or acts of terrorism.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and YatriCourier regarding the use of the Platform and supersede all prior agreements and understandings.
